Injury Law Results in Atlantic Canada

The injury law results the firm can point to by citation are two decisions, the largest personal injury decisions in Atlantic Canada. The firm’s lawyers tried and argued both. The client reviews describe each client’s own experience and are separate from these case results.

The Two Reported Injury Law Results Are Allen v. Doiron and Trainor v. DeArcos

Allen v. Doiron, 2026 NBKB 049, was tried in the Court of King’s Bench of New Brunswick in Moncton. The court assessed damages at $3.3 million for a catastrophic injury from a car accident. It is the largest personal injury decision in Atlantic Canada. The court also applied the seatbelt rule in the New Brunswick Insurance Act. That rule cuts damages by 25 percent where the plaintiff was not wearing a seatbelt, unless the plaintiff shows that this did not contribute to the injury.

Trainor v. DeArcos, 2025 NBCA 131, was decided by the Court of Appeal of New Brunswick. The court upheld $2.3 million on appeal for a chronic pain claim. It is the second largest personal injury decision in the region. It matters to any client whose injury is pain instead of a fracture on an x-ray, because a New Brunswick appellate court accepted the evidence that proves that kind of loss.

A Reported Decision Does Not Predict Your Claim

A reported decision shows what a court did with one set of facts. It does not predict what a court will do with yours. Damages depend on the injury, the evidence, the province’s cap or deductible, the benefits already paid and whether fault is shared. The advertisements vs results disclaimer says this in full. The firm asks every prospective client to read it before drawing a conclusion from this page.

Most claims settle before trial, and a settlement is confidential and is not listed here. The two decisions above are the firm’s public record and the firm has other results that are not public. What each type of claim is worth in each province, and why, is explained under injury law areas.

Client Reviews Are Not Case Results

Clients left these reviews on the firm’s Google profiles and on its social channels. They describe service, communication and the outcome as the client saw it. They are not ratings and they are not case results.
