Optional Section B Benefits and the Minor Injury Deductible in Newfoundland and Labrador
Newfoundland and Labrador differs from the Maritime provinces in two ways, and both change how much a motor vehicle claim is likely to pay out.
There is no minor injury cap. Instead the Automobile Insurance Act takes a deductible off pain and suffering damages in every motor vehicle claim. For accidents on or after 1 January 2020 that deductible is $5,000. The post on the minor injury deductible in Newfoundland sets out how the court applies it.
Section B accident benefits are optional here. The driver has to have added that coverage to the policy. So the first step is to read the policy, because it decides whether treatment and income replacement are paid before fault is settled. The post on Section B benefits in Newfoundland covers what the benefits pay when the policy has them.
The Limitations Act gives two years for a personal injury claim, with discoverability, and the clock does not run while the claimant is a minor. A claim based on sexual misconduct has no limitation period. Where WorkplaceNL covers a workplace injury, the worker cannot sue the employer. A claim may still lie against a third party outside the scheme.
